A 242 ss/an 04.04.2023 WPA 6492 of 2020 With CAN 1 of 2020 (Old CAN 5166 of 2020) Sri Chhoton Pramanik Vs.

The State of West Bengal & Ors.

Mr. Tapan Kumar Mukherjee, Sr. Adv.

Mr. Somnath Naskar ... ... for the State Mr. Amit Kumar Nag ... ... for the respondent nos.7 & 8

1. None appears for the petitioner.

2. This writ petition styled as public interest litigation the seeks to challenge LPG Distributorship granted to the 9th respondent by the Indian Oil Corporation.

3. Learned counsel for the Indian Oil Corporation submits that the distributorship has been granted by following the relevant rules and after obtaining requisite licences from the explosives department, the Food and Supplies Department and the District Magistrate.

4. It is pointed out that the petitioner was also an applicant for the distributorship but was unsuccessful and has come forward with this petition. To establish the same a list of applicants enclosed along with petition was placed from which we find that the name of the writ petitioner is in serial no.11. If that be so, the present writ petition cannot be treated as public interest litigation but a private interest litigation. The petitioner being an applicant himself cannot now state that the allocation of

distributorship is not conducive and such an objection at the instance of the writ petitioner is not maintainable. 5 Hence, the writ petition is dismissed.
