AGP Ms. Saswati Chatterjee ...for the State The petitioner claims to be the successful bidder of Sand Mining Auction in respect of plot nos. 1569(P) and 1571(P) within Mouza - Senai, JL No. 102 under Burwa Police Station in the district of Murshidabad. The petitioner claims to have deposited 1/3rd of the total bid amount. The petitioner submitted a representation before the concerned authorities with a prayer to allow him to deposit the arrear bid amount and for execution of the long-term lease. The grievance of the petitioner is that till date the longterm lease has not yet been executed. Mr. Mukherjee, learned advocate appearing for the petitioner places reliance upon a notification dated August 8, enabling the district administration to revalidate the L.O.I.s which had

been issued prior to the launch of the New Sand Mining Policy, 2021 and who already deposited the 1/3rd bid amount. Mr. Mukherjee further submits that the said notification dated August 8, 2025 was forwarded to the petitioner vide letter dated August 13, 2025 and immediately thereafter the petitioner by a letter dated December 22, 2025 prayed for inclusion of the plots in question in the DSR area and to extend the time for submission of the environmental clearance certificate for the purpose of extraction of sand. He further submits that since no steps were taken by the respondent authorities pursuant to the letter dated December 22, 2025, a subsequent letter dated February 25, 2026 was submitted before the respondent authorities. He submits that till date the authorities have not yet included the plots in question in the DSR area.

Mr. De, learned AGP, submits that necessary steps in accordance with law shall be taken and the decision on the representations submitted by the petitioner shall be communicated to the petitioner within the time limit as may be fixed by this Court. In the light of the submissions made by the learned advocates appearing for the respective parties, this writ petition stands disposed of without

entering into the claim made by the petitioner in the representations dated December 22, 2025 and February 25, 2026 and by directing the respondent authorities to consider the said representations in accordance with law and take consequential steps and complete the entire exercise as expeditiously as possible but positively within a period of 12 weeks from the receipt of a server copy of this order along with copy of the representations dated December 22, 2025 and February 25, 2026.

In case the authority/authorities contemplate(s) any adverse decision at any stage of the consideration, an opportunity of hearing should be provided to the petitioner or his authorized representative and the reasoned order shall be communicated to the petitioner immediately thereafter.
