Court No. 17 WPA 8409 of 2022 Nabakanta Chanda 23.06.2022 Vs.

The State of West Bengal & Ors.

(AD 92) (S. Banerjee) Mr. Gobinda Chandra Baidya Mr. Tirthankar Basu ... for petitioner Some kerosene oil was seized which was illegally stacked and ultimately by an order of the authority, being the Collector (EC), South 24 Parganas, the custody of the kerosene oil was given to one Mr. Anil Baran Chanda against furnishing Rs. 4 lacs which was furnished by said Mr. Anil Baran Chanda on 31.01.2022.

Today the petitioner has filed one application before this court. I do not understand and it is not disclosed in the said application what is the relationship between Mr. Nabakanta Chanda, the petitioner herein, and the said Mr. Anil Baran Chanda.

I find that the order was passed after issuing notice of hearing to all the parties and after giving opportunities to the parties. But some of the parties, despite notice, did not appear and I find that the entire proceeding was done following the principles of natural

justice and the decision was arrived at after fully following the procedure.

I do not find any infirmity in the procedure for passing the said order and, therefore, the prayer made for setting aside the order dated 31.01.2022, is wholly without any reason and without any merit.

Hence the writ application is dismissed.
