Versus

State of West Bengal & Ors.

Mr. Suchindram Bhattacharjee ...for the Petitioner.

Mr. Santanu Kumar Mitra, Mr. Mirza Kamruddin ...for the State-respondents.

Mr. Amitava Ghosh ...for the Respondent Nos.6 and 8.

The petitioner is satisfied with the action of the police authorities. It is submitted that the petitioner has been escorted back to the residential house.

Mr. Ghosh, learned Advocate appearing on behalf of the respondent Nos.6 and 8, submits that his clients have been thrown out. The petitioner strongly denies such contention. The police authorities also deny such contention. From the order passed by this Court, it does not appear that the Court had directed that the other residents of the house should be ousted. Thus, there is no order preventing the respondents Nos. 6 to 8 from peacefully enjoying the property. It is made clear that the police authorities shall ensure that the respondents do not create any further disturbance. The

petitioner, who is a senior citizen, has a right to reside in the residential accommodation, and the children are bound to maintain her.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
