Although the CESC Limited has, inter alia, suggested that the existing meter board cum service position be shifted to a technically safe and accessible locale, it has also been stated therein that the existing meter board at the premises has adequate space to install a new meter.

Since the private respondents choose not to appear despite service, the matter is taken up for disposal ex parte.

In view of the feasibility of the new connection being given to the petitioner having been affirmed by the CESC Limited, WPA No. 8797 of 2023 is disposed of by directing the CESC Limited to give a new

electricity connection to the petitioner at the existing meter board position of the premises-in-question as expeditiously as possible, subject to compliance of all formalities by the petitioner, positively within a fortnight from the date of such compliance of formalities.

In the event any resistance is put up by the private respondents and/or the private respondents' men or agents in doing so, it will be open to the CESC personnel to approach respondent no.3, the Officer-inCharge, New Market Police Station for adequate police assistance. If so approached, such assistance will be rendered by respondent no.3 by acting on a server copy of this order and at the cost of the petitioner. If need be, for such purpose, the police will be at liberty to remove any hindrance or padlock put up to prevent the access of the CESC personnel to the meter board position.

There will be no order as to costs.

Urgent Photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
