2. The writ application has been preferred challenging an order being No.

A/045/WB/00039/RO/BKP/DAM/7Q/Zone512/948 & 949 dated 06.10.2025, passed by the respondent no. 2 in absence of the Presiding Officer at the Central Government Industrial Tribunal-cum-Labour Court, Kolkata (CGIT) [Formerly Employees Provident Fund Appellate Tribunal].

3. It is stated that the petitioner has preferred an appeal before the CGIT, Kolkata against a composite order passed by the respondent authority under Section 14B and 7Q of the EPF Act. The said order is dated 06.10.2025.

4. It appears that the impugned order has been challenged before the Central Government

Industrial Tribunal and has been numbered as Appeal No. EPF 53 of 2025.

5. This Court finds that there is no order which has been challenged before this Court.

6. This writ application has been preferred praying for direction upon the respondent not to take any action on the basis of the order under Section 14B and 7Q of the Act dated 06.10.2025 as an appeal is pending and the CGIT, Kolkata does not have a regular Presiding Officer.

7. The petitioner has placed a certificate issued by the Recovery Officer dated 15.04.2026 in respect of his case that the respondents are taking coercive action against the petitioner.

8. It appears that in spite of an appeal pending, the respondents are proceeding against the petitioners herein as there is no regular Presiding Officer at CGIT, Kolkata.

9. Accordingly, the writ application is disposed of with the direction that the respondents shall not proceed with the notice dated 15.04.2026 and not take any coercive action against the petitioner till the disposal of the appeal.

10. Writ application is disposed of.

11. Connected application, if any, stands disposed of.

12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
