Sr. Standing Counsel Mr. Debopriyo Karan ... for the State Mr. Shahan Shah Mr. Soumen Barman Mr. Umenun Khan ...for the respondent No. 4 to 8 Petitioner is aggrieved by the fact that the private respondents are violating the preliminary decree passed by the Civil Court and trying to grab the petitioners property by flexing their muscles. Additionally it has also been alleged that the free egress and ingress of the petitioners are being obstructed at the behest of the private respondents. Learned Advocate for the private respondents on the other hand submit that the final decree is still to be drawn up by the Civil Court in connection with

partition suit no. 486 of 2012 and it has been informed that the next date is fixed on 19.05.2025. Be that as it may, police authorities are in knowhow of the dispute between the petitioners and the private respondents and to that effect it has been brought to the notice of the Court by way of a report that proceeding under Section 126 of the BNSS has been drawn by Nowda Police Station.

Having considered that the police authorities are keeping a strict vigil they would ensure that no further breach of peace and tranquility takes place and/or any untoward incident occurs because of the existing dispute wherein the Civil Court is already in seisin of the issue.

With the aforesaid observations WPA No.

8814 of 2025 stands disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to both the parties.

All parties shall act on the Server Copy of this order duly downloaded from the Official Website of this Court.
