1. Learned counsel for the petitioner submits that the present contempt application has become infructuous in view of the compliance of the direction of this court.

2. Learned senior counsel appearing for the alleged contemnors also corroborates such submission.

3. Learned senior counsel fairly submits, though, that there was delay in carrying out the same, since in the meantime an appeal was preferred against the parent order of this court.

4. Keeping in mind the circumstances in which the delay was occasioned, since the alleged contemnors had preferred an appeal, I do not find any occasion to penalize the alleged

contemnors for willful and deliberate violation of the order of this court.

5. In view of the above, CPAN 617 of 2024 is disposed of as infructuous.

6. There will be no order as to costs.

7. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
