Mr. Avishek Sinha Mr. Subhasish Datta ... for the State Learned counsel appearing for the petitioner submits that the victim was a married lady. An acquaintance between the victim and the petitioner grew from social media. They had a relationship. It is alleged that the petitioner had refused to repay the money taken from the victim and also refused to marry her. This prompted her to commit suicide. A married lady could not have been swayed by a promise to marry. The petitioner is not aware of any monetary transaction with the victim. There was a delay of about seven days in lodging the FIR. It could be that the victim died after being scolded by her husband.

Learned counsel for the State submits that the death took place due to poisoning. The husband of the victim alleged that the petitioner was in a relationship with his wife.

The petitioner took money from the victim and did not return the same. This is besides the fact that the petitioner had given a false promise to marry the victim. This version is supported by the statement of a friend of the victim who was also her neighbour. The bank manager has also given a statement that with instructions from the victim, the petitioner used to deposit money in the account of the petitioner's wife.

Considering the incriminating materials available in the case diary, especially the statement of the friend of the victim, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
