CRM 5839 of 2020 (Via Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Muchipara P.S. Case No.227 of 2019 dated 01.11.2019 under Sections 420/406/120B of the Indian Penal Code.

And In the matter of: Subhajit Chakravorty alias Subho alias Suvo ....Petitioner Mr. Sumanta Ganguly ...for the Petitioner Mr. Swapan Banerjee Ms. Purnima Ghosh ...for the State Mr. Abhradip Maity Ms. Pooja Basak ...for the de-facto complainant The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The previous order of September 8, 2020 required the petitioner to deposit a sum of Rs.8 lakh without prejudice to the petitioner's rights and contentions.

No such deposit has been made and it does not appear that the petitioner is inclined to make the deposit.

In such view of the matter, particularly since a direction to make the deposit was made by a coordinate Bench, the prayer for anticipatory bail is refused at this stage.
