Mr. Abhinaba Dan, learned advocate for the petitioner appearing on virtual mode submits that the petitioner preferred appeal challenging the order of termination of his licence by respondent no.6, Subdivisional Controller, Food & Supplies, Haldia before the District Controller, Food & Supplies, Purba Medinipur, being the respondent no.5. On 3rd January, 2024, hearing was concluded, however, no such order was passed. Hence, the petitioner is constrained to file the present writ petition. He informs the Court that the District Controller, Food & Supplies, Purba Medinipur, being the respondent no.5, in the meantime has

disposed of the appeal and as such the present writ petition has become infructuous. However, he seeks that a copy of the order passed in appeal by the District Controller, Food & Supplies, Purba Medinipur, being the respondent no.5 be handed over to the petitioner. Mr. Biswabrata Basu Mallick, learned advocate for the State-respondents submits that the appeal preferred against the order of termination has already been disposed of by the respondent no.5. He files a copy of the order dated 1st April, 2024 passed by the District Controller, Food & Supplies, Purba Medinipur, being the respondent no.5, which is taken on record. He also hands over a copy of the said order to learned advocate for the petitioner.

In view of the above submissions made at the Bar, the writ petition being W.P.A. 9506 of 2024 stands dismissed as infructuous.

All connected applications, if any, stand dismissed.

Interim order, if any, stands vacated.

There shall be no order as to costs.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
