Case No.114 of 2025 dated 31.01.2025 under Sections 126(2)/74/3(5) of the BNS, 2023 read with 4/10 of the POCSO Act, 2012.

Ms. Manisha Sharma Ms. Pushpita Saha ... for the State Affidavit of service filed in Court is taken on record. Despite service no one appears on behalf of the victim. Learned counsel appearing for the petitioner submits that the minor victim had a relationship with the petitioner for quite some time. There is a delay of about a month in reporting the alleged incident regarding rape. Learned counsel for the State relies on the statements of witnesses, including the victim recorded before the learned Magistrate as well as the injury report. The victim had taken the name of the prime accused before the learned Magistrate as well as the treating doctor.

In view of the materials available in the case diary and the statement of the victim recorded before the doctor and

the learned Magistrate, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
