The wife/respondent of the Matrimonial Suit No. 21 of 2010 is the petitioner of the present revisional application under Article 227 of the constitution of India.

The said matrimonial suit filed by the husband/opposite party seeking dissolution of marriage between the parties by a decree of divorce is pending before the 4th Court of learned Additional District Judge at Asansol.

The petitioner by the present application assailed the order dated March 18, 2021 passed by the learned District Judge, Paschim Burdwan at Asansol, dismissing an application filed by the petitioner under Section 24 of the Code of Civil Procedure being Misc. Case 02 of 2021 for withdrawal of the said suit from the Court where it is now pending and transfer of it to any other Court under the Judgeship of the said learned District Judge.

The petitioner sought withdrawal and transfer of the said suit on the basis of some bold allegations against the learned Trial Judge. She has not filed any material in support of her such allegation. The application for transfer is not even supported by a proper affidavit.

The learned District Judge, therefore, has not committed any error in dismissing the said application.

This Court does not find any reason to interfere with the said order.

C.O. 1051 of 2021 is dismissed without any order for costs.

The learned Trial Judge is requested to expedite the hearing and disposal of the said matrimonial suit.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
