Mr. Saheb Banerjee ..for the petitioners The petitioners have challenged the order no.2 dated 9th January, 2025 in T.S. 07 of 2025 by virtue of which the learned trial judge passed an ad interim order of injunction on an application filed under Order 39 Rule 1 and 2 of the Code of Civil procedure.

The ad interim order of injunction passed on 9th January, 2025 was extended by the order dated 7th February, 2025. The petitioners have challenged both the orders in the civil revisional application. The orders impugned are appealable under the provisions of Order 43 Rule 1(r ) of the Code of Civil Procedure. In view thereof, this Court is not inclined to entertain this application under Article 227 of the Constitution of India. At this stage the learned advocate on record of the petitioners prays for leave to withdraw this civil revisional application with liberty to approach the appropriate forum in accordance with law. In the light of the submissions made by the learned advocate on record of the petitioners, C.O. 1347

of 2025 stands dismissed as withdrawn with liberty to the petitioners to approach the appropriate forum in accordance with law.

The learned advocate on record of the petitioners is permitted to take back the certified copy of the order impugned upon replacing the same with a photostat copy thereof.
