Mr. Avinaba Patra Mr. S. Ghosh Mr. D. Kundu ....for the petitioners Mr. Anupam Das Adhikari Ms. Rajashree Tah ....for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioner no. 1 has already been arrested. As such, the application is not pressed so far as he is concerned. The other petitioners have been falsely implicated in this case. No grievous injury was caused.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statement of the victim and the statements of eye-witnesses, which implicate the petitioners. According to the injury report, there were 5 cut injuries, one over the upper lip and four over a vital part of the body like the scalp. In all, eight stitches had to be given for repairing the wounds. As the petitioner no. 1 has already been arrested, his application for anticipatory bail is dismissed as having become infructuous.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the petitioner nos. 2 to 9. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
