2. State of West Bengal The matter is listed today after a long period of time. The petitioner husband has challenged the order dated 27.6.2014 passed by learned Judicial Magistrate, Ulberia, Howrah in Misc. Case No. 2 of 2013 under Section 125 of the Cr.P.C., wherein the petitioner was directed to pay maintenance of Rs.2,000/- per month to the opposite party. Since filing of this application, the petitioner has not taken any steps. It appears that in this application, the petitioner has denied the marriage and contended that the order allowing maintenance in favour of the opposite party is arbitrary.
On transversing the impugned judgment, I find that the opposite party did not appear before the Trial Court nor did he file any written objection against the application filed by the petitioner in spite of service of notice of the case.
In view of such matter and long pendency of this case, I am not inclined to grant any further accommodation to the petitioner. The revisional application is dismissed for default. There is no interim order of stay relating to the proceeding and execution in Misc. Case No. 2 of 2013.
