Learned counsel for the petitioner submits that, during the pendency of the writ petition, a decision has been taken by the District Magistrate on the grievance raised by the petitioner in respect of allegedly illegal installation of electricity pole on the petitioner's land.

Learned counsel submits that, accordingly, he has instruction not to proceed any further with the present writ petition, seeking liberty to challenge the order of the District Magistrate.

Accordingly, WPA No. 8443 of 2022 is dismissed for non-prosecution.

This order of dismissal shall not prevent the petitioner from challenging the decision of the District Magistrate in respect of refusal of the petitioner's grievance before any competent forum.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
