P.C. for quashing of the proceedings of T.R. Cases No.42 of 2014 arising out of SL No.306 of 1314 dated 31.3.2014 under Section 46A(c) of the Bengal Excise Act, 1909 pending before the Additional Chief Judicial Magistrate at Alipore, 24Parganas South. The matter was dealt with by the Hon'ble Court on 17th April, 2015 when an order of stay of all further proceedings was passed for a period of eight weeks.

The stay was extended time to time.

On 6th March, 2019 the Coordinate Bench of this Court was pleased to reject the prayer for extension of interim order directing the case to be

fixed for hearing under the heading "Contested Application".

The matter thereafter appeared on several occasions.

However, the hearing was not done and on 17th August, 2022 a request was made to Mr. Sandip Chakraborty, learned Advocate to appear on behalf of the Officer-in-Charge of Excise, Behala Circle. After that the matter did not appear and is running in the Warning List since 21.2.2025.

Today no one appears on behalf of the petitioner.

In view of the above facts and circumstances and considering that no interim order is in force as of date and further considering the long pendency of the matter, this Court is not inclined to adjourn the matter further.

Accordingly, this revisional application stands dismissed for default In view of the above, all connected applications are also dismissed for default.

Let a copy of this order be forwarded to the learned court of ACJM, Alipore, 24-Parganas South for necessary information.
