...for the State Petitioner is aggrieved by the fact that inspite of 21.05.2025 Court No. 35 Item No.8 Rakib informing the police authorities attached to Dholahat Police Station, no steps have been taken. The accusations are that the petitioners are being threatened by the private respondents who are influential persons and they often abuse and assault the petitioner and his family members. On a number of occasions the police authorities have been informed but the police authorities have not taken steps and kept silent by recording G.D. Entries. Petitioner has also approached the Executive Magistrate. Petitioner presently is apprehensive as the police authorities according to him had threatened removal of his name from records of rights.

State has submitted a report. Report reflects that there is a dispute in respect of land which is the subject matter in the writ petition. So far as the police authorities are concerned, police authorities have drawn up proceedings as and when called for under Section 107 of Cr.PC. as also under Section 126 of BNSS.

If the petitioner has material in his possession to establish that a cognizable offence has been made out, petitioner would approach the jurisdictional Magistrate under the relevant provisions of law and in case any direction is passed by learned A.C.J.M., the police authorities would respect, obey and implement for unearthing the truth associated with the accusations. With the aforesaid observations WPA 8818 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to learned advocate appearing for the petitioner.
