The order proposed to be passed in the present revisional application under Article 227 of the constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present revisional application upon the said opposite parties is dispensed with. The petitioner is the defendant of Title suit No. 262 of 2020 pending before the 2nd Court of learned Civil Judge (Junior Division) at Sealdah. The petitioner complains that he is suffering an ad interim order of injunction passed on October 17, 2020 in the suit which is still subsisting and pendency of the said application for injunction is causing hardship to him.
The petitioner prays for a direction upon the learned Trial Judge for expeditious disposal of the said application.
The application under Order XXXIX Rules 1 & 2 of the Code of Civil Procedure by its nature demands expeditious disposal.
The learned Trial Judge, therefore, is requested to expedite the disposal of the said application if it is otherwise ready for such disposal and in doing so shall not grant any unnecessary adjournment to either of the parties.
C.O. 1054 of 2021 is thus disposed of without any order as to costs.
