In the matter of : Sumanta Rana ..... petitioner Mr. Siddharthan Sarkar .....For the petitioner The petitioner was granted an interim order of maintenance of Rs.9,000/- per month dated September 15, 2018 by the learned Magistrate in the Court below in a proceeding under Section 125 of the Code of Criminal Procedure, 1973.

The petitioner challenged the order before the learned Sessions Judge below. It was the case of the petitioner before the learned Sessions Judge that after passing of the interim order, he removed from his service and therefore, the order of the learned Magistrate should be notified.

It has been submitted by the learned advocate for the petitioner that maintenance application before the learned Magistrate is still pending for final decision. I do not see any reason to interfere with the reasoned order of the learned Sessions Judge impugned in the petition. Liberty is given to the petitioner to bring into the notice of the learned Magistrate as to his removal from service for the purpose of deciding the quantum of maintenance finally.

With this observation, this revisional application being CRR 1201 of 2021 is disposed of.
