Kausik (Rejected) CRM (NDPS) 740 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar P.S. Case No. 1389 of 2025 dated 01.07.2025 under sections 21(c)/27A/29 of the NDPS Act, 1985.

Petitioner along with other accused persons are strategically delaying the proceedings before the learned Special Court, number of adjournments are reflected. The order which has been enclosed is of 18.02.2026 which reflects that after dates having been fixed an application for discharge was filed by one of the accused person.

Having considered the notion with which the accused persons are progressing and the consequence faced by the learned Special Court, I am not inclined to release the petitioner on bail.

As such the prayer for bail of the petitioner in CRM (NDPS) 740 of 2026 is dismissed.
