Learned advocate for the petitioner submits that the petitioner is in custody for 252 days. Prosecution has submitted charge sheet and has relied upon 28 witnesses in order to prove its case. The case is yet to be committed to the court of sessions. As such, petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and draws attention of this court to the statement of witnesses which was recorded before the learned judicial magistrate under section 183 BNSS.

I have taken into account the materials available in the case diary. A rumour was spread that the deceased was a witch on the basis of which the relations struck the deceased to death with the head of an iron rod. The petitioner inflicted vital blows when other relations held the deceased. The deceased succumbed to the injuries. Considering the manner in which the rumour was spread and the deceased was assaulted to death, I am of the view that this is not a fit case to grant bail to the petitioner.

Accordingly, CRM (M) 962 of 2026 is dismissed. (Tirthankar Ghosh, J.)
