This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner praying for quashing of GR case No.1258 of 1975 arising out of Manickchalk Police Station case No.8 dated 20.08.1975, under Section 447/379 of the Indian Penal Code pending before the learned Chief Judicial Magistrate, Malda. Learned advocate for the State/opposite party draws my attention to the previous order dated 16.6.
2011 where the petitioner was directed to file certified copy of the order sheet in connection with the case within a fortnight, in default, the matter will stands dismissed. The petitioner has not taken any steps thereafter. No interim order has been passed in respect of proceeding of GR case No.1258 of 1975.
Considering the facts and circumstances and the default on the part of the petitioner, the criminal revision is dismissed for default.
Let a copy of this order be sent to the court of learned Chief Judicial Magistrate, Malda for information.
