The petitioner appeared in person has submitted that in compliance of the order of this Hon'ble Court dated February 13, 2023 in connection with C.O.No. 324 of 2023. Petitioner filed an application for substituted service before the learned Civil Judge, Junior Division, District Delegate, Durgapur but that application has not yet been disposed of. It is further submitted that the probate case is pending since 2022 which is required to be disposed of expeditiously.

No notice is required to be served upon the respondents.

Service of notice is dispensed with.

Learned Trial Court is requested to dispose of the application dated February 15, 2023 for substituted service as well as suit as expeditiously as possible without giving any unnecessary adjournment to any of the parties. The petitioner is at liberty to communicate this order to the learned Trial Court.

With the aforesaid observation the instant revisional application being C.O. No. 1176 of 2023 is disposed of. There shall be however no order as to costs.
