The petitioner has filed the present writ application challenging the selection of the private respondent as the first empanelled candidate for grant of licence in his favour. The petitioner claims that a representation has been made against the private respondent, which has not been considered by the respondent authority.

Learned advocates representing the private respondent and the State-respondent submit that licence has already been issued in favour of the private respondent and allotment has been granted.

At this stage, there is no scope for passing any direction upon the respondents to consider the representation of the petitioner as the licence has already been issued in favour of the private respondent. If the petitioner is at all aggrieved then appropriate action is required to be taken for cancellation of licence. That not

being the prayer, no relief can be granted in favour of the petitioner in the instant case.

Accordingly, the writ petition fails and is hereby dismissed.
