(Through Video Conference) The petition is pending since 2017 and has been adjourned earlier also on account of non-appearance of counsel for the petitioner.
Since no one is present today, therefore we have perused the record.
The petitioner is seeking a direction to the official respondents to take action against the respondent nos. 7 and 8 and also police protection to the petitioner so that he can enter into the land and garden in question in plot no. 1092 and 1098 at Mouza Mirapur, P.O. - Hansury, P.S.- Magrahat, District - South 24-Parganas. The plea raised in the petition reveals that the petitioner is claiming the land in question to be his property and also that certain Debdaru Trees were grown in that land which allegedly were cut by the private respondents.
The grievance raised by the petitioner is personal in nature. Even otherwise the affidavit-in-opposition filed the respondents reveals that the action has already been taken against the private respondents.
That apart, after filing of the petition in the year 2017 more than four years have passed. Therefore, it is
not clear that the grievance of the petitioner is still surviving.
Hence, we dismiss the petitioner, however, with liberty to the petitioner to raise his personal grievance before appropriate forum in accordance with law. (Prakash Shrivastava, C.J.) (Rajarshi Bharadwaj, J.)
