Mr. S. Mukherjee, Mr. S. Sarkar, Ms. Anindita Chattopadhyay ...for the petitioner In this application the petitioner has prayed for a direction upon the Court below for expeditious disposal of G.R. Case No.1533 of 2024 presently pending before learned Judicial Magistrate, 4th Court, Durgapur.

Being aggrieved by the inordinate caused in disposal of the said proceeding, learned Counsel for the petitioner submits that on the basis of petitioner's complaint, Coke Oven Police Station Case No.157 of 2024 was started on 2nd August, 2024. Thereafter, the Investigating Agency submitted charge-sheet on 31st August, 2024 and the Court below took cognizance of the offence on 18th September, 2024. Since then various dates have been fixed by the Court below for appearance but charge hearing has not yet been conducted.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice, and, as such, service of

copy of application upon the opposite parties is hereby dispensed with.

Having considered submissions made by learned Counsel for the petitioner and also considering the fact that the proceeding of the case has been stalled since September 18, 2024, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 1662 of 2026 is hereby disposed of with a direction upon the Court below to secure the attendance of the accused persons on the next date and to conduct the charge hearing on that date or within a period of 30 days thereafter. In case, any of the accused persons are absconding, the Court below will split the case record in respect of the absconding accused and will proceed further.
