It is further submitted that the learned trial court could not pass any order in respect of the said application due to the pendency of the present revisional application. Accordingly, considering the prayer of the opposite party no.1/complainant and the materials on record, the present revisional application is disposed of with the direction upon the complainant/opposite party no.1 to pray for withdrawal of the complaint petition before the trial court positively by 4th October, 2023 and pray for necessary relief, if any, before the trial court. Affidavit of service filed in court be kept with the record. The revisional application is accordingly, disposed of.
