1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is a retired employee of the Calcutta State Transport Corporation (CSTC). His allegation is that leave encashment which is available for a maximum period of 300 days has not been paid to him fully, except only for a period of 180 days. The payment for the balance period of 120 days is due and payable.

3. It appears that there is no representation from the side of the petitioner demanding his claim before the authority.

4. Prior to filing the instant writ petition, the petitioner ought to have approached the authority with his prayer for disbursement of leave encashment which is alleged to be due. Without filing the representation, the instant writ petition ought not to have been filed.

5. Nevertheless, as prayer has been made seeking liberty to file representation, the instant writ petition stands disposed of with the

observation that it will be open for the petitioner to file representation before the authority highlighting his grievance.

6. If any representation is made, the same shall be considered by the authority in accordance with the prevailing rules.

7. A reasoned order shall be passed and communicated to the petitioner.

8. The writ petition stands disposed of.

9. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
