Mr. Probal Sarkar ..for the Petitioner Mr. Pantu Deb Roy Mr. Pannalal Bandyopadhyay ....for the State Affidavit of service filed by the petitioner is taken on record.

None appears for the respondents despite service. Mr. Pantu Deb Roy learned advocate, who usually appears on behalf of the State and is present in Court today, is requested to represent the State alongwith a junior of his choice in this matter. The concerned authority is requested to regularise their appointment in this matter. The petitioners are directed to serve a copy of this application along with annexure thereto upon Mr. Deb Roy in course of this day.

The petitioners complain that the private respondents are trying to enter the property of the petitioners and disturb their peaceful possession therein on the basis of forged deeds. Complaints lodged by the petitioners before the police have not been taken care of. In the event the police authority has failed to take steps pursuant to complaints lodged by the petitioners, the

petitioners are at liberty to approach the jurisdictional Magistrate for redressal of their grievance under Section 175 of the BNSS. In the meantime the police authority is directed to keep vigil over the area so that no untoward incident takes place and law and order is maintained. The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
