The grievance of the petitioner is directed against inaction of WBSEDCL in providing an electricity connection to the premises of the petitioner. On behalf of the WBSEDCL, it is submitted that though initial steps have been taken for providing such connection, there is local resistance from the inhabitants and hence, no such connection can be provided to the petitioner.

On behalf of the private respondents, it is submitted that though they have initially objected to the grant of such connection, the same has since been resolved.

In view of the nature of disputes raised on behalf of the parties, the entire issue of supply of electricity

connection to the premises of the petitioner is remanded to the concerned District Magistrate having jurisdiction to decide the issue of such electricity connection after hearing all the parties including the local residents, if necessary.

It is made clear that there has been no adjudication on the merits of the case and all issues are left open for the District Magistrate to decide in accordance with law.

The above exercise has to be completed preferably within weeks from the date of communication of this order.

WPA of stands disposed of accordingly.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
