The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioners in connection with Basirhat P.S. Case No. 115 dated 19.03.2007 (G.R. No. 422/07) under Section 14(F) of the Foreigners Act.
Records of the case reveal that the application for bail was preferred in the year 2007. The subject-matter of the case relates to Foreigners Act. Order-sheets reflect that lastly the matter appeared on 20.04.2007 for verification. As the application for bail is pending for more than fourteen years and none has pursued the matter before this Court for such long period, I am of the view that the present bail application has become infructuous.
Accordingly, the application for bail, being CRM 3562 of 2007, is dismissed as infructuous.
