Ray, Ms. Manisha Sharma ...for the State The present revisional application was preferred for quashing the supplementary chargesheet filed in connection with Basanti Police Station Case No.28 dated 31.05.1998 under Sections 147/ 148/ 149/ 427/ 448/ 379/ 326/ 302/ 436 of the Indian Penal Code, Sections 25/27 of the Arms Act and Section 9(b) of the Indian Explosives Act.
Records reflect that the revisional application was admitted on 17.04.2012. However, the interim order was only for a period of ten weeks. Thereafter, the interim order was never extended. The grievance of the petitioners is that though they are discharged earlier in the chargesheet but subsequently, they have been implicated in the supplementary chargesheet. It seems that supplementary chargesheet has been submitted after materials
are collected by the investigating agency and the investigating agency on the said materials came to a conclusion that case for trial has been made out against the other accused persons. Having regard to the aforesaid fact that this Court is of the view that no interference is called for so far as the contentions advanced by the petitioners are concerned.
Accordingly, the revisional application being C.R.R.1286 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
