Learned counsel appearing on behalf of the State submits that pursuant to the order dated 03.05.2024 passed by this Court, on 13.05.2024, the Ranger Officer of Garchumuk Deer Park handed over the live seized exotic birds along with certified copy of four dead certificates of seized exotic birds which died during this period to the Investigating Officer, Special Task Force who, in turn, handed over and gave zimma of all the seized birds and the certified copies to the accused petitioner namely, Soumen Biswas.

Learned counsel appearing on behalf of the petitioner submits that it is unfortunate that four of such exotic birds died while being kept in the custody of the Investigating Agency. Since the prime grievance of the petitioner has already been redressed, no further order need be passed in this regard. Accordingly, the writ petition is disposed of.

However, the petitioner shall be at liberty to pray for appropriate relief in respect of the death of four of such exotic birds.

If any post mortem of such birds had been done, let the same be handed over to the petitioner within seven days from this date.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
