For the respondents It is submitted by the petitioner and reiterated by the respondents that during the pendency of the writ petition, a Terms of Settlement has been arrived at between the petitioner and his employer - the Indian Association for the Cultivation of Science (in short "IACS"). A copy of the original Terms of Settlement is produced before this Court. A photocopy of the Terms of Settlement is retained with the record.

One of the terms of Settlement is that the settlement will come into effect after withdrawal of the instant writ petition.

The petitioner says that he intends to withdraw the writ petition so that the Terms of Settlement can be honoured.

On behalf of the IACS, it is submitted that immediately after withdrawal of the writ petition, necessary

steps will be taken in terms of the Terms of Settlement dated 5th August, 2022.

The writ petition is, therefor, dismissed as withdrawn, with liberty to the petitioner to approach the appropriate forum in the event the Terms of Settlement dated 5th August, 2022 is not honoured.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
