27.04.2026 Court No.28 Item No.58 ssi CRM (A) 1180 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Amherst Police Station Case No. 122 of 2025 dated 10.10.2025 under Sections 118 (1)/ 3 (5) of the BNS 2023 and 25 (1B) (a) Arms Act. And In the matter of: Md. Fahim.

Petitioner Md. Zeeshan Uddin Mr. Abu ...for the petitioner Mr. S. S. Imam Ms. Snigdha Saha ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. The son of the petitioner was granted anticipatory bail by this Court earlier by an order dated 12.02.2026 passed in CRM (A) 181 of 2026. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the injury report and the statements of the victim and other local witnesses.

Considering the above, the other materials available in the case diary and the fact that the petitioner stands substantially on the same footing as his son who was granted anticipatory bail earlier by this Court, although I am inclined to grant anticipatory bail to the petitioner, his movement shall remain restricted for a limited period. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.

Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall co-operate with the investigation and shall meet the I.O. once a week till submission of report in final form. The petitioner shall not threaten or intimidate the witnesses. The petitioner shall stay outside the jurisdiction of Amherst Police Station for a period of four months from this date, except for attending the jurisdictional Court or meeting the Investigating Officer or casting his vote in the ensuing assembly election.

The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
