The ground for review of the order dated 28.02.2024 is that in terms of the applicable rules a person who has completed and approved confirmation in service for two years is eligible to apply for transfer. The impugned order is therefore liable to be reviewed.

The Secretary, Board of Primary Education shall consider the petitioner's application for transfer for a period after receiving appropriate report from the DPSC, South 24 Parganas within a period of 12 weeks from date.

Let a copy of the writ petition and a copy of this order be communicated to the Secretary of the

Board forthwith. The Secretary and all parties shall take the decision offline.

The review application is allowed and disposed of.

CAN 1 of 2024 is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
