The present revisional application was preferred challenging the proceedings being Case No.C-1059 of 2006 under Sections 138/141 of the Negotiable Instruments Act pending before the learned Judicial Magistrate, 5th Court, Alipore. Records of the revisional application reflects that the same is pending before this Court for the last eight years and is yet to be admitted.

Having regard to the relevant provisions of the Negotiable Instruments Act where the legislature has expressed its intention of concluding the proceedings within a limited period of time, I am of the opinion that further pendency of the revisional application before this Court is unwarranted.

Records also reflect that at any point of time any efforts was taken by the present petitioners for canvassing the grievance raised in the revisional application before this Court. I also find from the contentions advanced in the revisional application that the issues raised are question of facts which cannot be gone into by this Court at this stage.

Accordingly, CRR 783 of 2013 is dismissed.

Pending application, if any, is consequently disposed of.
