The father of the petitioner was an Assistant Teacher of a Junior High School who died-in-harness on September 09, 2017.

The District Inspector of School (S.E.), District: Uttar Dinajpur, the respondent no.3 herein by his order bearing Memo No. 3973/1(1) dated November 21, 2019 has rejected the prayer of the petitioner for compassionate appointment.

A report was invited from the said respondent and the same was filed. It appears from the said report that the family income of the petitioner is more than the monthly salary of a Group-D staff of a State Government employee which disentitles the petitioner to get compassionate appointment.

There is no illegality and/or infirmity in the order impugned warranting interference, W.P.A. 8871 of 2023 is accordingly dismissed without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
