Report submitted by Mr. Arijit Ganguly, learned advocate appearing for the State reflects that the Investigating Officer of Jamuria P. S submitted his report after the investigation before the jurisdictional court praying for discharge of all the accused persons as no evidence could be established against them in course of the investigation. It also appears from the report that the next date of hearing is fixed on 4th June, 2023 for consideration of such report. Mr. Debasis Roy, learned advocate appears on behalf of the petitioners and prays for liberty to be granted in case there is an adverse finding of the learned Magistrate while considering the report so submitted by the Investigating Authorities. For the present, the present revisional application has become infructuous. Accordingly, the present revisional application being CRR 1206 of 2021 is disposed of as infructuous. Pending applications, if any, are consequently disposed of.

Petitioners are at liberty to approach this court in case the learned Magistrate refuses to accept the report under Section 173 of the Code of Criminal Procedure filed by the Investigating Authorities. Report submitted by Additional Officer-in-Charge, Shakespeare PS through he learned advocate for the State be kept with the record.
