Vaisya Mr. Pinaki Bhattacharya ..for DPSC, North 24 Parganas I am directing the Secretary of the West Bengal Board of Primary Education to look into the allegation of the petitioner specially in paragraphs 20 and 21 of the writ application where the petitioner has claimed 4.5 marks more. The Secretary shall give an opportunity of hearing to the petitioner within a period of four weeks from the date of communication of this order and the petitioner shall be at liberty to be represented through his learned advocate. After hearing, the Secretary will pass one reasoned and speaking order within a period of two weeks from the date of hearing and to communicate the same to the

petitioner immediately thereafter.

The affidavit in opposition filed today by the respondents which does not bear any relevant fact to counter the allegations made in the writ application is kept on record though it is of no use before this court. Therefore, the question of giving opportunity to file affidavit in reply does not arise. The Secretary shall call for the original records of this matter from the concerned District Primary School Council and will consider the same on the date of hearing in presence of the petitioner or his learned advocate.

The petitioner is directed to send a copy of the writ application forthwith to the Secretary of the West Bengal Board of Primary Education along with a copy of this order.

The writ application is disposed of. The application being CAN 1 of 2022 is also disposed of. (Abhijit Gangopadhyay, J. )
