AGP Ms. Saswati Chatterjee ...for the State Petitioners claim to be the owners of several plots of land within Mouza Bhannra, under Kulti Police Station in the district of Paschim Bardhaman. Petitioners allege that a proceeding was initiated for acquisition of various plots of land including the plots of the petitioners for extension of the railway track. Petitioners allege that though some portion of the property of the petitioners has been utilised for the purpose of laying railway track, the compensation amount has not yet been disbursed in favour of the petitioners. Petitioners submitted representations before various authorities praying for release of the compensation in favour of the petitioners. Since no decision on such representation was communicated
to the petitioners, petitioners submitted a letter dated May 15, through his learned advocate requesting the Additional District Magistrate (LA) to pay the compensation amount to the petitioners. Learned advocate appearing for the petitioners submits that in spite of receipt of such representation, no decision on such representation has been communicated to the petitioners till date. Heard the learned advocates appearing for the respective parties.
Mr. De, learned AGP submits that the decision on the representation dated May 15, 2025 shall be communicated to the petitioners within the time limit that may be fixed by this Court.
In the light of the submissions made by the learned advocates appearing for the respective parties, this writ petition stands disposed of by directing the ADM(LA), Paschim Bardhaman to consider the representation of the petitioners and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorized representative and any other person or authority whose presence may be deemed necessary to arrive at a decision on such
representation and to communicate the reasoned order to the petitioners and other authorities/persons as expeditiously as possible but positively within a period of eight weeks from the receipt of a server copy of this order along with a copy of the representation dated May 15, 2025. It is, however, made clear that it would be open to the petitioners to place reliance upon any material/document in support of their claim for compensation before the respondent no. 7 at the time of hearing and if such document is placed, such authority shall consider the same and pass orders in accordance with law.
