Mr. Asim Hati, Ms. Nandini Sharma ...for the Petitioner Mr. Washef Ali Mondal ...for the University In this writ petition, the petitioner has challenged a suspension order dated December 26, 2022. The petitioner is an Assistant Professor at Raiganj University. It appears from the suspension order that the same has been issued for his detention in the custody beyond 48 hours in connection with a criminal case.

It has, however, been submitted by the university that a charge sheet has been filed by the investigating agency against the petitioner in the meantime and in view of that subsequent development, the university will review the said suspension order dated December 26, 2022.

In view of the stand taken by the university, this writ petition is disposed of granting liberty upon the petitioner to make a representation before the university seeking revocation of the suspension order dated December 26, 2022 within three weeks from date. If such representation is made, the university shall

revisit the suspension order within a period of one month thereafter, keeping in the mind that the charge sheet has already been submitted against the petitioner before the competent criminal court.

WPA 8875 of 2023 is disposed of.

The petitioner will be at liberty to communicate this order.
