The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The defendant no.1 in a suit for declaration, partition and cancellation of deed of gift and permanent injunction being Title Suit No. 143 of 2015 pending before the learned Civil Judge (Senior Division), Hooghly, Chinsurah is the petitioner of the instant application.

The petitioner is praying a direction upon the learned Trial Judge for expeditious disposal of the said suit.

It appears from the record that though the suit once was posted for peremptory hearing but after the prayer of the petitioner for amendment of

plaint was allowed, the suit has been taken off from the peremptory hearing Board.

The learned Trial Judge has fixed the date for filing of the additional written statement by the defendants.

In view of such stage of the suit, this Court is not inclined to pass the direction as prayed for. However, the suit since is pending since 2015, the learned Trial Judge therefore is requested to expedite the disposal of it without entertaining the prayer of the parties for any unnecessary adjournments.

C.O. 1218 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
