1. In pursuance of the direction passed by this Court, respondent nos. 1 to 5 are present before this Court.

2. The State is also represented.

3. Mr. Kaustav Roy, learned Advocate for the appellant submits that the appellant does not intend to proceed further with the present appeal. A petition is filed by the appellant Ashalata Santra stating that she intends to withdraw this appeal and she files this petition voluntarily. The said petition submitted by the appellant be taken on record.

4. This instant appeal is preferred at the behest of the appellant challenging the impugned judgment and order of

acquittal dated 30th March, 2000 passed by the learned Magistrate in connection with C.R. Case No. 355 of 1999 filed under Section 323/504/554 of the Indian Penal Code.

5. I perused the impugned judgment and order passed by the learned Trial Court as well as have gone through all the materials gathered in the record. I find there is nothing material to interfere with the said impugned judgment. There is no illegality or material irregularity in the said judgment. Accordingly, the impugned judgment and order passed by the learned Trial Court needs to be affirmed.

6. Accordingly, the instant appeal be and the same is hereby dismissed on merit.

7. The impugned judgment and order dated 30th March, 2000 passed by the Trial Court in connection with C.R. Case No. 355 of 1999 is hereby affirmed.

8. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
