Mr. Joyak Kumar Gupta, learned counsel appearing on behalf of the petitioners submits that a Misc. case filed by his clients under Section 34 of the Indian Trust Act, 1882 was dismissed by the order impugned holding that the trust is a religious trust and outside the purview of the provisions of the Indian Trust Act, 1882.

Mr. Gupta further submits that the petitioners have already initiated a proceeding under Section 3 of the Charitable and Religious Trust Act, 1920 before the 2nd Court of learned Civil Judge, (Junior Division), at Sealdah for necessary direction and in view of such development, the petitioners are not willing to press this application. Considering such stand of the petitioners, C.O. 1062 of 2021 is dismissed as not pressed without any order as to costs.
