Banerjee) Mr. Sayak Chakraborti Mr. Shwashtwik Chatterjee ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for direction upon the learned Civil Judge (Sr. Division), Diamond Harbour, South 24 Parganas to dispose of T. S. No. 33 of 2022 expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial Judge.

From the order-sheets appended to this application this Court finds that the hearing of the application under Order 39 Rule 1 and 2 and the

application under Order 39 Rule 4 of the Code of Civil Procedure, have been fixed on July 28, 2025.

In view thereof, CO 1359 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Division), Diamond Harbour, South 24 Parganas to take up the hearing of the applications under Order 39 Rule 1 and 2 and Order 39 Rule 4 of the Code, on the next date fixed, i.e., on July 28, 2025, if the same are otherwise ready for hearing and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory applications, the learned trial Judge is requested to make an endeavour to see that the suit is disposed of expeditiously.
