It is submitted on behalf of the petitioner that 71 bottles of phensedyl containing codeine phosphate was allegedly recovered from the possession of the present petitioner and after completion of investigation, police submitted charge sheet on June 11, 2024. The charge was framed on January 10, 2025, but since then prosecution could not examine a single witness. The petitioner is in custody for about 1 year and 6 months and nobody knows when the trial would be concluded and as such he may be released on bail on any terms and conditions. Learned counsel appearing on behalf of the State opposed the bail prayer contending that the bail prayer of the present
petitioner was rejected on January 7, 2025 and since then no new circumstance has been brought to the notice of the court to consider the bail prayer of the petitioner favourably Having considered the submissions made on behalf of the learned advocate for the petitioner and the State and that no new circumstance has arisen since last rejection order and that the rigour of Section 37 of the NDPS Act clearly attracts in the present case in respect of the present petitioner, the bail prayer stands rejected.
CRM (NDPS) 483 of 2025 is disposed of.
Urgent certified copy of this order, duly applied for, be given to the parties upon compliance with all requisite formalities.
