The learned advocate for the petitioners submits that the initial order for maintaining peace and tranquility was passed by the learned Executive Magistrate, Bolpur, Birbhum on March 12, 2020. In view of the passage of time the said order has lost its force.
I have perused the order passed by the learned Executive Magistrate in MP Case No. 97 of 2020 and on an appreciation of the same, I am of the opinion that the statutory period so provided under Section 144 Cr.P.C. has elapsed and as such the whole of the proceeding before the learned Magistrate has become infructuous.
In view of the aforesaid, the learned Executive Magistrate is directed not to proceed with the matter any further and drop the proceeding.
The parties are granted liberty to approach the civil Court. The revisional application being CRR 1127 of 2020 and the application being IA No. CRAN/1/2020(Old No. 4416 of 2020) are disposed of.
